LOMARA PROPERTIES GUEST AGREEMENT
Please carefully review and understand all terms, policies, rules, and procedures contained within this Guest Agreement prior to arrival. By completing the reservation, accessing the property, or permitting occupants or visitors onto the property during the reservation period, the booking guest and all occupants acknowledge and agree to comply with all policies, rules, safety requirements, and enforcement provisions contained herein.
Guests are financially responsible for any damages, excessive cleaning, fines, citations, penalties, legal expenses, homeowner association violations, or other costs resulting from negligence, misuse of the property, unauthorized conduct, or violations of this Guest Agreement. Violations of house rules or local ordinances may result in immediate removal from the property without refund.
CHECK-IN
Standard check-in time begins at 3:00PM unless otherwise approved by the property owner. Check-in instructions, access information, and property details will generally be provided approximately 24 hours prior to the scheduled arrival date.
Early check-in requests must be submitted in advance and are subject to availability, cleaning schedules, maintenance requirements, and operational needs. Complimentary early check-in at 2:00PM may occasionally be accommodated when available; however, earlier arrivals are not guaranteed.
Check-in requests earlier than 2:00PM may incur an early arrival fee of $50 per hour or partial hour, which must be approved and processed prior to arrival. Unauthorized early entry onto the property, including use of outdoor amenities, parking areas, or access attempts prior to the approved check-in time is strictly prohibited.
CHECK-OUT
Standard check-out time is no later than 11:00AM unless otherwise approved by the property owner. Check-out instructions will generally be provided approximately 24 hours prior to departure.
Late check-out requests must be submitted in advance and are subject to availability, cleaning schedules, upcoming reservations, maintenance requirements, and operational needs. Complimentary late check-out until 12:00PM may occasionally be accommodated when available; however, extended departures are not guaranteed.
Approved check-out requests later than 12:00PM may incur a late departure fee of $50 per hour or partial hour expensed to the booking guest within 30 days after the check-out date. Departure times extending after 1:00PM without prior approval may result in an additional nightly rate, relocation costs for incoming guests, cleaning schedule fees, or other operational fees expensed to the booking guest.
Guests are expected to leave the property secured and in reasonably orderly condition upon departure, including closing and locking doors and windows, turning off light fixtures, appliances, and fire features, disposing of trash and recycling in designated receptacles, and following all provided check-out instructions.
Guests and all occupants must vacate the property no later than then approved check-out time unless prior authorization for a late departure has been granted by the property owner. Unauthorized occupancy beyond the approved reservation period is strictly prohibited and may result in additional nightly rates, trespassing enforcement, removal from the property by local authorities, legal action, attorney fees, and any associated costs incurred by the property owner. Acceptance of payment for additional time shall not constitute consent to continued occupancy or create any landlord-tenant relationship.
OCCUPANCY
The maximum occupancy limit for Mockingbird Villa is four guests. The maximum occupancy limit for Solicio del Sol is ten guests. Occupancy limits include overnight guests in addition to visitors present at the property during the reservation period.
The names of all guests staying at or visiting the property must be disclosed to the property owner prior to the check-in date. Occupancy limits are strictly enforced in accordance with local ordinances, insurance requirements, and neighborhood regulations. Unauthorized guests, parties, gatherings, events, or occupancy violations are strictly prohibited.
Any violation of occupancy limits or unauthorized guest policies may result in immediate removal from the property without refund, and may subject the booking guest to fines, penalties, or citations imposed by local authorities. Any fines, fees, damages, or related expenses incurred as a result of occupancy violations will be expensed to the booking guest within 30 days after the check-out date.
SECURITY
Guests are responsible for securing the property during their reservation and upon departure. All windows, doors, sliding glass doors, and entrances must remain closed and locked whenever guests depart the property or retire for the evening. Guests are also responsible for securing personal belongings and locking all vehicles on or near the property.
At Soclio del Sol, the front door may be locked by pressing and holding the “#” button on the digital keypad for approximately two seconds. At Mockingbird Villa, guests are requested to keep the front door closed during periods of high winds in order to prevent damage to the door, hinges, and hardware.
Guests shall not attempt to access locked closets, storage areas, utility rooms, garages, maintenance spaces, or restricted areas. Tampering with locked or restricted areas is strictly prohibited.
The property owner shall not be held liable for lost, stolen, or damaged personal belongings, vehicles, valuables, or other property belonging to guests or visitors while on the property. Guests acknowledge, accept, and assume full responsibility for securing their personal items throughout the duration of their reservation.
CAMERAS
For the safety and security of guests, neighbors, and the property, exterior security cameras are installed at both properties. At Mockingbird Villa, one exterior security camera is located on the corner of the garage overlooking the driveway and front exterior area. At Solicio del Sol, exterior security cameras are located at the front entry and above the garage overlooking the driveway and exterior area.
Security cameras are positioned exclusively in outdoor public-facing areas and do not monitor any interior living spaces, bedrooms, bathrooms, changing areas, private outdoor shower areas, or other locations where privacy is reasonably expected.
The exterior security cameras do not record live audio conversations and are used solely for security, insurance, safety, occupancy verification, property protection, and enforcement of house rules and local ordinances. Tampering with, disabling, obstructing, covering, disconnecting, or damaging security devices or related equipment is strictly prohibited and may result in immediate removal from the property without refund, in addition to repair or replacement costs expensed to the booking guest within 30 days after the check-out date.
SMOKING AND VAPING
Smoking, vaping, electronic cigarettes, marijiuana, cigars, hookahs, pipes, and all other smoking devices or substances are strictly prohibited inside the property. This policy applies to all indoor areas, including bedrooms and bathrooms.
The property is equipped with Minut monitoring devices designed to detect cigarette smoke, marijuana smoke, and vape fumes. These devices do not record conversations, live audio, or video, and are used solely for safety, property protection, and enforcement of house rules. In addition, smoke detectors and carbon monoxide alarms are installed throughout the property.
Any evidence of indoor smoking, vaping, smoke or marijiuana odors, drug paraphernalia, vape residue, excessive incense, or related violations may result in a minimum cleaning and deodorization fee of $500 expensed to the booking guest within 30 days after the check-out date. Additional costs for ozone treatment, upholstery cleaning, HVAC cleaning, damaged linens, or remediation services may also apply if necessary.
Guests are responsible for ensuring cigarettes, cigars, matches, ashes, vape devices, and smoking materials are safely extinguished and properly disposed of in designated outdoor receptacles only. Discarding cigarette butts, ashes, or smoking materials onto landscaping, patios, walkways, gravel, or flower beds is strictly prohibited due to extreme fire risk.
Violation of the smoking or vaping policy, tampering with smoke detectors or monitoring equipment, or facilitating unsafe fire conditions may result in immediate removal from the property without refund, in addition to any cleaning, repair, citations, or remediation expensed to the booking guest.
FIREARMS, WEAPONS & HAZARDOUS ITEMS
Firearms, ammunition, explosives, fireworks, BB guns, pellet guns, airsoft weapons, slingshots, bows, crossbows, illegal weapons, hazardous materials, and dangerous devices are strictly prohibited on the property. Guests shall not store, carry, brandish, discharge, display, clean, or operate firearms or weapons on the property or around the premises.
The possession or operation of weapons in violation of this policy may result in immediate removal from the property without refund, and may be reported to local authorities when deemed necessary for the safety of guests, neighbors, vendors, or surrounding properties.
Guests are solely responsible for ensuring that all occupants, visitors, invitees, and members of their party comply fully with this policy throughout the duration of the reservation. Any damages, safety risks, disturbances, legal violations, or liabilities arising from prohibited weapons, or hazardous items shall be the sole responsibility of the booking guest.
PETS & WILDLIFE
A maximum of two pets are permitted at the property for Mockingbird Villa only. Only dogs and cats are allowed. A non-refundable pet fee of $50 per pet will be expensed to the booking guest at the time of reservation.
Guests are required to supervise pets at all times during their stay. Pets must never be left unattended outdoors, particularly during nighttime hours. The property is located in a natural desert environment where wildlife, including but not limited to coyotes, bobcats, cougars, snakes, and birds of prey may be present. These animals may pose a serious threat, injury risk, or even death to unsupervised pets. Guests acknowledge, accept, and assume full responsibility for the safety, supervision, and control of their pets while on the property. The property owner shall not be held liable for any injury, disappearance, illness, attack, death, or other harm caused by the wildlife or other natural hazards.
Any damage caused by pets, including but not limited to stains, odors, excessive hair, scratching, chewing, or additional cleaning will be expensed to the booking guest within 30 days after the check-out date.
Pets are strictly prohibited at Solicio del Sol. Violation of the no-pet policy will result in a minimum fee of $250 expensed to the booking guest within 30 days after the check-out date. Any property damage, excessive cleaning, odors, allergens, or other expenses associated with unauthorized pets will be the sole responsibility of the booking guest and may result in immediate removal from the property without refund.
PARKING
Access to the garage is not permitted to guests. Guests may park in the designated driveway areas only.
At Mockingbird Villa, the driveway can accommodate two vehicles. Street parking is limited and guests are requested to avoid impeding neighborhood driveways, public access roads, mailboxes, or emergency access routes at any time.
At Solicio del Sol, the driveway can accommodate two vehicles. A maximum of four additional vehicles may be parked on the street approved areas located alongside or directly across from the property. Guests must ensure all vehicles are legally parked and do not obstruct neighboring homes, driveways, sidewalks, traffic flow, sanitation access, or emergency services.
Parking on unpaved desert landscaping, gravel areas not designated for parking, or neighboring properties is strictly prohibited. Guests are responsible for any fines, towing fees, property damage, homeowner association violations, or other expenses resulting from improper parking or unauthorized vehicles.
Recreational vehicles, trailers, campers, moving trucks, commercial vehicles, and oversized vehicles are not permitted on the property unless prior authorized approval has been granted by the property owner. Unauthorized vehicles may be subject to towing at the expense of the guest.
INTERNET & WIFI
Complimentary WiFi internet service is provided for guest convenience at the property. While the property owners make reasonable efforts to maintain reliable interest access, WiFi service is provided through third-party utility providers and uninterrupted connectivity, speeds, coverage, compatibility, or continuous operation cannot be guaranteed.
Temporary outages, reduced speeds, service interruptions, router malfunctions, weather-related disruptions, utility failures, maintenance issues, or provider-related outages may occasionally occur and shall not constitute grounds for refunds, discounts, credits, or cancellation of the reservation.
Guests are prohibited from using the internet service for unlawful activity, excessive bandwidth usage, hacking, downloading illegal content, spamming, network abuse, or any activity that interferes with the operation security, or performance of the network or connected devices on the property. Tampering with routers, modems, smart home devices, network equipment, or security systems is strictly prohibited.
The property owner will make reasonable efforts to coordinate with the internet service provider in the event of service interruptions; however, repair timelines and restoration of service remain outside the reasonable control of the property owner.
POOL & HOT TUB RULES
Glassware and glass bottles are strictly prohibited in or around the pool and hot tub. Any broken glass discovered inside the pool or hot tub will result in a minimum cleaning and drainage fee of $500 expensed to the booking guest within 30 days after the check-out date. Additional repair, cleaning, refill, or equipment damage costs may also apply if necessary.
Guests shall not urinate, defecate, vomit, or otherwise release bodily fluids into the pool or hot tub. Any evidence of bodily emissions, contamination, excessive debris, or conditions requiring drainage, chemical treatment, sanitation, or temporary closure of the pool or hot tub will result in a minimum cleaning fee of $500 expensed to the booking guest within 30 days after the check-out date. Additional remediation or repair costs may also be expensed if applicable.
Guests shall enjoy the pool, hot tub, and all outdoor amenities at their own risk. No lifeguard is on duty. Children must be supervised by an adult at all times while outdoors and near aquatic features. Running, diving, or unsafe behavior in or around the pool and hot tub is strictly prohibited.
The pool and surrounding outdoor areas are not enclosed by a child safety fence, gate, or lock at Solicio del Sol. By booking the reservation, guests acknowledge, accept, and assume full responsibility for supervising children and all members of their party while enjoying or accessing outdoor amenities. The property owner shall not be held liable for accidents, injuries, drowning, death, or other incidents occurring on the property.
Guests are advised not to use the hot tub while under the influence of alcohol, drugs, medications causing drowsiness, or while experiencing medical conditions that may be aggravated by heat exposure, including heart conditions, high or low blood pressure, pregnancy-related risks, dizziness, or illness. Guests acknowledge, accept, and assume all risks associated with the enjoyment of the pool and hot tub amenities.
At Solicio del Sol, complimentary hot tub heating is available daily between the hours of 6:00PM and 10:00PM. Hot tub heating may only be enabled and operated by the property owner. Guests are requested to notify the property owner in advance to request activation and allow approximately 45 minutes for the hot tub to achieve the desired temperature.
For safety, maintenance, and energy conservation purposes, hot tub heating will automatically be deactivated at 10:00PM each evening with no exceptions. At Mockingbird Villa, guests are requested to cover the hot tub when the hot tub is not in use in order to preserve heat, maintain water quality, and protect equipment functionality.
Guests shall not tamper with, adjust, disable, or attempt to override any pool or hot tub equipment, heating systems, timers, pumps, valves, control panels, or maintenance settings. Unauthorized interference with pool or hot tub equipment may result in damage, system shutdown, or additional maintenance costs, which will be expensed to the booking guest within 30 days after the check-out date.
The property owner does not guarantee uninterrupted operation of the hot tub or heating equipment due to weather conditions, maintenance requirements, utility interruptions, mechanical issues, or circumstances beyond reasonable control. Partial or temporary interruptions or hot tub heating or operation shall not constitute grounds for refunds, discounts, or cancellation of the reservation.
OUTDOOR GRILL, WOOD-BURNING STOVE & FIRE PIT RULES
Guests operate fire pits, wood-burning stoves, outdoor grills, and propane appliances at their own risk. Children and pets must be supervised at all times while fire features are being operated. Guests are responsible for exercising caution and maintaining safe distances from open flames and hot surfaces.
Guests are welcome to enjoy the outdoor grill during their reservation. Guests are responsible for operating the grill safely and ensuring it is deactivated after each use. The grill should be left in a reasonably clean condition, including removal of excessive food debris, grease buildup, or spills. Excessive cleaning, damage caused by misuse, grease fires, or failure to properly disable the propane equipment may result in additional cleaning, repair, or propane refill fees expensed to the booking guest within 30 days after the check-out date.
Wood-burning fires, bonfires, fireworks, sparklers, candles, tiki torches, and any unauthorized open flames are strictly prohibited on the property. Only installed property fire pits or wood-burning stoves may be operated. Guests shall not burn wood, paper, cardboard, trash, leaves, or any other combustible materials within the fire pit.
Guests are prohibited from tampering with propane tanks, gas lines, ignition systems, burner, lava rocks, glass protectors, or fire pit controls. If a fire feature appears damaged, malfunctioning, or unsafe, guests must discontinue use immediately and notify the property owner.
Fire pits must be fully deactivated after each use. Guests are responsible for ensuring flames are extinguished before leaving the outdoor area unattended or retiring for the evening. Fire features shall not be operated during high winds, unsafe weather conditions, or burn advisories.
The property owner does not guarantee uninterrupted operation of the fire pits or outdoor grills due to weather conditions, maintenance requirements, utility interruptions, mechanical issues, or circumstances beyond reasonable control. Partial or temporary interruptions of fire pits or outdoor grills or their operations shall not constitute grounds for refunds, discounts, or cancellation of the reservation.
The property owner shall not be held liable for injuries, burns, smoke inhalation, property damage, clothing damage, or other incidents resulting from misuse of fire features or failure to follow posted instructions and safety precautions. Any damage, excessive cleaning, propane loss, or repairs resulting from misuse or negligence will be expensed to the booking guest within 30 days after the check-out date.
AIR CONDITIONING & CLIMATE CONTROL
Guests are requested to operate all heating, ventilation, air conditioning, mini-split, and climate control systems responsibly during their reservation. To aid in the preservation of equipment functionality, reduction of excessive energy consumption, and maintenance of indoor comfort, guests are requested not to set thermostats lower than 70°F (21°C) or higher than 80°F (26°C) unless otherwise approved by the property owner.
When air conditioning or heating systems are in operation, guests are requested to close all exterior doors, windows, sliding glass panels, and entrances whenever reasonably possible in order to maintain system efficiency, reduce dust and humidity, and prevent unnecessary strain on equipment.
Guests shall not tamper with HVAC equipment, thermostats, mini-split systems, utility panels, condensers, breakers, filters, sensors, or climate-control components. Any damages, service calls, frozen systems, excessive wear and tear, or repairs resulting from misuse, negligence, or failure to follow operational guidelines may result in additional costs expensed to the booking guest within 30 days after check-out.
The property owner does not guarantee uninterrupted operation of heating, cooling, internet, utilities, or smart-home systems due to weather conditions, utility interruptions, maintenance requirements, equipment malfunctions, or circumstances outside the reasonable control of the property owner. Reasonable efforts will be made to address issues as promptly as possible; however, temporary interruptions shall not constitute grounds for refunds, discounts, or cancellation of the reservation.
SANITARY SYSTEM & PLUMBING
Guests are requested to operate all plumbing, septic, sewer, and sanitary systems responsibly during their reservation. Only toilet tissue is permitted to be flushed in toilets. Guests shall not flush wipes of any kind, paper towels, feminine hygiene products, diapers, cotton products, plastics, food waste, grease, oils, wrappers, dental floss, excessive tissue, or any foreign materials through the plumbing or sanitary systems.
Improper operation of toilets, sinks, showers, drains, garbage disposals, or plumbing fixtures may result in clogs, backups, flooding, water damage, plumbing failure, or service interruptions. In the event of an overflow, leak, blockage, or plumbing emergency, guests are requested to immediately discontinue operation of the affected fixture, shut off the water supply if safely possible, and notify the property owner promptly.
Guests may be held financially responsible for plumbing service calls, repairs, drain clearing, septic pumping, water damage remediation, disposal replacement, or other maintenance expenses resulting from misuse, negligence, or prohibited items introduced into the plumbing or sanitary systems. Such costs may be expensed to the booking guest within 30 days after the check-out date.
Guests are also requested to operate garbage disposals responsibly by running cold water during operation and avoiding bones, fibrous foods, grease, oils, coffee grounds, shells, fruit pits and peels, paper products, or other materials likely to damage or obstruct the disposal system.
QUIET HOURS & NUISANCE POLICY
In accordance with local ordinances and neighborhood regulations, quiet hours are strictly enforced daily between 10:00PM and 7:00AM. Guests are expected to respect neighborhood properties and maintain reasonable noise levels at all times throughout the reservation period.
Parties, events, large gatherings, amplified music, DJs, subwoofers, outdoor speakers, excessive shouting, disruptive behavior, chronic barking or howling from pets, or other nuisance activity that disturbs neighbors or the surrounding community are strictly prohibited. Any conduct deemed excessive, disruptive, unsafe, or in violation of local ordinances may result in immediate removal from the property without refund.
The property is equipped with Minut monitoring devices that detect elevated noise levels and occupancy-related disturbances. These devices do not record conversations, live audio, or video, and are used solely for safety, property protection, and enforcement of house rules and local ordinances.
Guests are responsible for any fines, penalties, citations, legal expenses, homeowner association violations, community enforcement actions, or other costs resulting from noise complaints, nuisance activity, unauthorized gatherings, or violations of local regulations. Such expenses may exceed $3,000 and will be expensed to the booking guest within 30 days after the check-out date.
Guests are also requested to respect neighboring properties, refrain from trespassing, avoid obstructing shared access areas, and conduct themselves in a courteous and respectful manner throughout the duration of their reservation.
FURNITURE & INTERIOR FURNISHINGS
Guests are requested to respect and treat all furniture, decor, artwork, mattresses, linens, appliances, and interior furnishings with care and to use all items only for their intended purpose. Indoor and outdoor furniture shall not be relocated, removed from the property, dragged across flooring surfaces, or exchanged between indoor and outdoor areas.
Guests shall not stand on furniture, place damp items directly onto wood or upholstered surfaces, use indoor furnishings outdoors, or use towels, linens, bedding, or decorative items for cleaning, makeup removal, pet care, or outdoor use. Excessive staining, odors, burns, scratches, breakage, discoloration, or damage to furnishings, mattresses, rugs, linens, decor, flooring, or surfaces may result in additional cleaning, repair, restoration, or replacement fees expensed to the booking guest within 30 days after the check-out date.
Guests are encouraged to immediately report accidental spills, stains, or damage in order for appropriate treatment or professional cleaning may be arranged before permanent damage occurs.
THEFT OR DAMAGE
Guests are responsible for the condition of the property and all furnishings, decor, appliances, electronics, and household items provided during the reservation period. Any items that are missing, stolen, damaged, destroyed, excessively stained, or rendered inoperable during the reservation may result in replacement, repair, cleaning, sanitizing, labor, shipping, or administrative costs expensed to the booking guest within 30 days after the check-out date.
Guests are requested to promptly notify the property owner of any accidental damage, maintenance concerns, malfunctioning equipment, or broken items during their reservation in order for repairs or replacements may be addressed or arranged in a timely manner. Failure to report damage may result in additional fees if further property damage or operational issues occur as a result.
The property owner reserves the right to pursue reimbursement claims for damages exceeding security deposits, platform protections, or standard cleaning fees, including damages caused by negligence, misuse, unauthorized guests, unauthorized parties or events, pets, or violations of house rules.
PROPERTY CLEANLINESS
Guests are expected to leave the property in a reasonably clean and orderly condition upon the check-out date. Excessive mess, negligence, biohazards, stains, odors, spills, trash accumulation, or conditions requiring deep cleaning beyond standard turnover service may result in additional cleaning fees expensed to the booking guest within 30 days after the check-out date.
A deplorable or excessively unclean condition may include, but is not limited to, excessive trash scattered throughout the property; spills or stains on furniture, linens, rugs, mattresses, walls, cabinets, counters, or flooring; food waste exposed unsecured; excessive grease or residue; bodily fluids; smoke or pet odors; excessive sand, dirt, glitter, confetti, or mud; or scratches, burns, or damage to surfaces, appliances, cabinetry, furniture, or decor.
Bed linens, bath towels, pool towels, blankets, and other provided textiles are intended solely for normal guest use during the reservation period and shall not be removed from the property. Makeup, self-tanning products, hair dye, oils, grease, bleach, or other staining substances should not be used with towels, linens, upholstery, or bedding in a manner likely to cause permanent damage. Excessive staining, missing linens, damaged textiles, or theft of property may result in replacement or restoration fees expensed to the booking guest within 30 days after the check-out date.
Daily housekeeping or laundry service is not included during the reservation period. Guests are requested to dispose of trash and recycling properly, clean excessive spills, and leave the property in respectful condition prior to departure.
The property owner reserves the right to document the condition of the property before check-in and after check-out, including through photographs or video recordings for security, insurance, maintenance, and reimbursement purposes. Any damage, theft, missing property, excessive cleaning, or rule violations identified after guest departure may result in additional fees expensed to the booking guest within 30 days after the check-out date.
INSECTS, PESTS & NATURAL DESERT CONDITIONS
The properties are located within a natural desert environment where insects, wildlife, rodents, reptiles, birds, spiders, ants, mosquitoes, flies, moths, beetles, and other pests may occasionally be present despite routine pest control and preventative maintenance services. While reasonable efforts are made to maintain clean and comfortable accommodations, complete eliminations of insects or wildlife within a desert environment cannot be guaranteed.
Guests may aid in the reduction of pest activity by keeping doors and windows closed, promptly disposing of trash, properly storing food, avoiding leaving food outdoors, and keeping outdoor lighting and entrances secure whenever possible.
The occasional presence of insects, desert pests, wildlife, dust, wind, pollen, vegetation debris, or other natural occurring environmental conditions shall not constitute grounds for refunds, discounts, relocation, or cancellation of the reservation.
If guests experience excessive pest activity or maintenance concerns during their reservation period, they are requested to notify the property owner promptly in order for reasonable corrective measures may be arranged when possible.
SECURITY, SAFETY & EMERGENCY PROCEDURES
In the event of a life-threatening emergency, guests should immediately contact 911 or local emergency services before contacting the property owner. Non-emergency maintenance concerns, property issues, or operational questions should be reported promptly with the contact information provided in the check-in instructions and guest handbook.
Guests are responsible for maintaining the security and safety of the property throughout the duration of their reservation. All windows, doors, sliding glass panels, gates, and entrances should remain closed and locked whenever guests leave the property or retire for the evening. Guests are also responsible for securing personal belongings, valuables, and vehicles at all times.
The property owner or authorized vendors may require reasonable access to the property during the reservation period for emergency repairs, maintenance, inspections, landscaping, pest control, utility service, safety concerns, or protection of the property. Whenever reasonably possible, guests will be notified in advance regarding scheduled maintenance visits or vendor access.
Guests are instructed not to provide access to the property to unauthorized individuals under any circumstances. If any suspicious activity, unauthorized access attempts, safety concerns, or emergency situations occur, guests are requested to contact local authorities when appropriate and notify the property owner immediately.
The property owner shall not be held liable for lost, stolen, or damaged personal belongings, vehicles, valuables, mail, packages, or other property belonging to guests or visitors while on the property.
CANCELLATION POLICY
Guests shall receive a 100% refund if the reservation is cancelled more than 30 days prior to the scheduled check-in date.
Guests shall receive a 50% refund if the reservation is cancelled within 14 and 30 days prior to the scheduled check-in date.
Guests shall receive no refund if the reservation is cancelled less than 14 days prior to the scheduled check-in date. No refunds, credits, or reimbursements will be issued for late arrivals, early departures, no-shows, weather conditions, utility interruptions, road closures, travel disruptions, personal emergencies, illness, dissatisfaction with natural desert conditions, wildlife activity, smoke from regional fires, or circumstances outside the reasonable control of the property owner.
Guests are strongly encouraged to purchase independent travel insurance in order to protect against unforeseen cancellations, interruptions, medical emergencies, transportation disruptions, or other related issues and losses.
Approved refunds, when applicable, will be issued only to the original booking guest through the original payment method used for the reservation.
ARBITRATION AGREEMENT
If the property owner retains legal counsel or incurs legal expenses as a result of violations by the guests of this Guest Agreement, property damage, unpaid fees, unauthorized occupancy, rule violations, negligence, local citations, or other prohibited conduct, the booking guest shall be responsible for all reasonable attorney fees, court costs, collection costs, filing fees, arbitration expenses, enforcement costs, and related legal expenses incurred by the property owner, whether or not formal legal proceedings are initiated.
To the fullest extent permitted by applicable law, the parties knowingly and voluntarily waive any right to a jury trial for disputes, claims, or litigation arising from or related to the reservation, occupancy, use of the property, or enforcement of this Guest Agreement.
Any dispute, claim, controversy, or cause of action arising from or relating to this Guest Agreement, the reservation, the occupancy or use of the property, alleged damages, payments, fees, cancellations, injuries, liability, or the breach or enforcement of any provision contained herein shall be resolved exclusively through binding arbitration.
Such arbitration shall be conducted in accordance with the applicable rules of the American Arbitration Association or other mutually agreed upon arbitration services, and judgment upon the arbitration award may be entered in any court having proper jurisdiction. The parties agree to waive the right to participate in class action lawsuits, class arbitration proceedings, or representative claims to the fullest extent permitted by law.
The prevailing party in any arbitration or legal proceeding arising from this agreement shall be entitled to recover reasonable attorney fees, arbitration expenses, court costs, and related legal expenses to the extent permitted by applicable law.
RELEASE & WAIVER OF LIABILITY & INDEMNIFICATION AGREEMENT
By booking the reservation, entering the property, or permitting any occupants or visitors onto the property during the reservation period, the booking guest and all occupants acknowledge, accept, and voluntarily assume all risks associated with the use of the property and surrounding premises. Such risks include, but are not limited to, use of the pool, hot tub, fire features, outdoor amenities, stairs, walkways, desert terrain, wildlife, weather conditions, parking areas, landscaping, and all interior and exterior portions of the property.
Guests agree to release, waive, discharge, defend, indemnify, and hold harmless the property owner, property management affiliates, employees, contractors, representatives, and partners from and against any and all claims, demands, actions, damages, liabilities, losses, fines, penalties, expenses, settlements, judgments, or legal fees arising from or related to the reservation, occupancy, use of the property, guest conduct, visitor conduct, accidents, injuries, illness, death, theft, property damage, or violations of house rules and local ordinances.
The properties are privately owned, and the property owner shall not be held liable for accidents, injuries, illness, death, lost of stolen belongings, vehicle damage, wildlife encounters, utility interruptions, temporary equipment failures, acts of nature, environmental conditions, or other incidents occurring on or around the property and the surrounding premises. Guests accept full responsibility for the conduct, supervision, and safety of themselves, their children, invitees, visitors, pets, and all occupants associated with the reservation.
Guests further agree to reimburse the property owner for any damages, excessive cleaning, fines, penalties, homeowner association violations, government citations, legal expenses, or other costs resulting from negligence, misuse of the property, unauthorized occupancy, parties and events, smoking, pets, violations of this agreement or local ordinances, or other prohibited conduct.
By completing the reservations and accessing the property, the booking guest acknowledges that they have reviewed, understood, and agreed to all terms, conditions, policies, rules, releases, and liability provisions contained within this Guest Agreement.
